It might vary from state to state. When I worked in HR in a completely different industry, I could reply with "yes" or "no" when asked if a former employee was eligible for re-hire, but not say anything about why if the answer was negative.
I suggest that you get out in front of this and let prospective employers know up front that you were let go. You don't have to get into all the gory details; HR at your former store can't, legally, so there's no need for you to either. But you can put your spin on it, keeping your explanation short and simple.
That said, if this is the kind of thing that will show up on a criminal background check, then you might want to take some serious time and figure out how to respond. When I found out that an interviewee lied to me in the interview about stuff that showed up on the background check, it didn't matter how well they interviewed and how glowing their references were. That application was put in the "nope, no way" file.
